Set-off

Set-off is an Affirmative Defense and generally cannot be raised solely on a post-trial motion. Jojo's Clubhouse, Inc. v. DBR Asset Mgmt., Inc., 860 So.2d 503, 504 (Fla. 4th DCA 2003), citing Kellogg v. Fowler, White, Burnett, Hurley, Banick & Strickroot, P.A., 807 So.2d 669, 670 (Fla. 4th DCA 2001). A defendant can claim set-off based on amounts already awarded to the Plaintiff in another lawsuit.
